BOOK CA NOTARY TERMS OF SERVICE Last Updated: July 24, 2026 Effective Date: July 20, 2026 Please read these Terms of Service carefully. By using this website or requesting services from Book CA Notary, you agree to these Terms. 1. About Our Services Book CA Notary is a mobile notary practice serving California. All notarial acts are performed by a duly commissioned California notary public in accordance with the California Government Code, the California Secretary of State’s Notary Public Handbook, and applicable California law. Fees for notarial acts are set by California law and applied uniformly to every appointment. A travel fee may also apply and will be disclosed to you in writing before your appointment is confirmed. 2. No Legal Advice A notary public is prohibited by California law from drafting, explaining, interpreting, or providing legal advice about the documents you sign. If you have questions about the content, effect, or accuracy of a document, you should consult a qualified California-licensed attorney before your appointment. 3. Appointment Requests and Confirmation Submitting a request through our website is only a request for service. It is not a confirmed appointment. We will contact you to confirm the date, time, location, and any documents or identification needed. If we cannot accept your appointment request, we will let you know as soon as reasonably practicable. 4. Identification and Eligibility California law requires that every signer appearing before a notary present satisfactory, current, government-issued photo identification unless another identification method is permitted by law for the specific notarial act. If we cannot verify identity to the standard required by law, we cannot perform the notarial act. In that event, any travel fee or other fee may still apply if disclosed in advance and permitted by law. We may also refuse service when required by law or when circumstances make the notarial act improper or unlawful. 5. Refusals A notary is required or permitted to refuse to notarize when, among other things, the signer is not personally present, does not have proper identification, appears not to understand the nature of the act, appears to be under duress, or the requested act would violate California law. A refusal to notarize does not constitute legal advice. 6. Fees and Payment All fees are disclosed before your appointment is confirmed. Payment is due at the time of the appointment unless otherwise arranged in writing. Accepted payment methods are listed on our website and may change from time to time. Any legally permitted travel fee, cancellation fee, or no-show fee will be disclosed in advance and applied only as permitted by law. 7. Cancellation, Rescheduling, and No-Shows You may reschedule or cancel your appointment at any time by contacting us as soon as possible. If we have already traveled to the appointment location, a travel fee may still apply if it was disclosed in advance and is permitted by law. If you are not present at the scheduled time, do not have the required identification, or otherwise cannot proceed with the appointment, the appointment may be treated as a cancellation or no-show, and any disclosed travel fee may still apply. 8. Document Uploads and Booking Materials If you upload documents through our booking form, those documents are used only for the purpose of preparing for and completing your requested service, unless we are otherwise required or permitted to use or retain them by law. Uploaded booking documents are retained according to the retention period configured in our booking system. After that configured retention period expires, the files are securely deleted from encrypted storage and the deletion action is recorded in an audit log. If the retention period is set to 0, automatic deletion is disabled, and the files remain in storage until an administrator deletes them or the related booking is deleted. We do not attach uploaded booking documents to email. We do not share them outside the service process except as necessary to provide the requested service, comply with law, or protect our rights and safety. If you request deletion of uploaded booking documents, we will delete them when operationally feasible, unless we must retain them for legal, regulatory, accounting, dispute-resolution, security, or business-record purposes. Records that we are legally required to keep, including notary journal entries and other legally required records, cannot be deleted to the extent required by law. 9. Notary Journal and Required Records California law requires every notary public to maintain a sequential journal of notarial acts. The notary journal is a legal record protected under California law and may be disclosed only when required or permitted by law. We retain required records for the periods required by law and for such additional time as may be necessary to comply with legal obligations, resolve disputes, enforce agreements, and protect against fraud or misuse. 10. Limitation of Liability Our services are provided in accordance with applicable California law, including the statutes and regulations governing notaries public, and subject to the terms of our surety bond and errors-and-omissions insurance. To the fullest extent permitted by law, Book CA Notary, its owner, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of our website or services. To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to a notarial act or our services is limited to the lesser of: (a) the amount recoverable under the applicable surety bond or errors-and-omissions policy, or (b) the amount you paid to us for the specific service giving rise to the claim. Nothing in these Terms limits liability to the extent such limitation is prohibited by law, including liability for gross negligence, willful misconduct, fraud, or any non-waivable statutory rights. 11. Website Use You agree not to misuse our website, including by attempting to interfere with its operation, accessing it without authorization, submitting false information, or using it in a manner that violates applicable law. We may suspend or deny access to the website or services if we reasonably believe there has been misuse, fraud, or unlawful conduct. 12. Communications By contacting us or submitting an appointment request, you consent to us contacting you about your request, appointment, or requested notary service using the contact information you provide. If you provide a mobile number and consent to receive texts, you may receive appointment-related calls or text messages. Message and data rates may apply from your carrier. You may opt out of non-essential text messages by replying STOP where applicable. 13. Privacy Our collection and use of personal information are described in our Privacy Policy. By using our website or services, you acknowledge that you have read our Privacy Policy. 14. Third-Party Services and Links Our website may contain links to third-party websites or services. We are not responsible for the content or privacy practices of those third parties. If we use third-party booking, payment, analytics, map, or embedded services, those providers may collect and use information under their own terms and privacy policies. 15. No Guarantee of Availability or Outcome We do not guarantee that we will be available for any particular appointment request, nor do we guarantee that any requested notarial act can be completed. Completion of a notarial act depends on compliance with California law, proper identification, personal appearance, and all other legal requirements being satisfied. 16. Governing Law and Venue These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms, our website, or our services shall be brought exclusively in the state or federal courts located in Sacramento County, California, unless applicable law requires otherwise. 17. Changes to These Terms We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and revise the “Last Updated” date above.
