Do You Need Witnesses When Notarizing a Document in California?
Witness requirements depend on the document and the notarial procedure
There is no single witness rule for every California notarization. An ordinary acknowledgment or jurat does not automatically require a separate document witness merely because a signature is notarized. Your document or its governing requirements may call for witnesses, while credible identifying witnesses serve a different purpose under California notarial law.
Confirm document-witness requirements with your attorney or the receiving organization. Then tell Mary about them before requesting mobile notary service. Book CA Notary does not guarantee that witnesses can be supplied.
Understand the different witness roles
Document witnesses observe or attest to execution as required for the particular document. The number, qualifications, and required signing procedure depend on that document’s rules. Do not assume that a friend, relative, beneficiary, or facility employee is eligible.
Credible identifying witnesses help establish a signer’s identity only when California’s legal conditions are satisfied. They are not simply substitute document witnesses, and bringing someone who knows you does not automatically resolve an identification problem.
The Secretary of State handbook describes one-witness and two-witness identification procedures, each with required oaths and conditions. These include personally knowing the signer, prescribed identification requirements, and restrictions concerning interest in or being named in the document. Ask Mary to review the circumstances before the visit rather than deciding which procedure applies yourself.
Subscribing witnesses and signatures by mark involve other specific procedures. They should not be treated as a general way to avoid personal appearance or ordinary signing requirements. Disclose these situations before scheduling.
A checklist for coordinating witnesses
- Obtain the complete document and any signing instructions from its preparer or recipient.
- Ask whether document witnesses are needed, how many are needed, and who can qualify. Get legal advice where the answer depends on interpreting the document or law.
- Tell Mary what you were instructed to arrange and whether anyone has identification or signing difficulties.
- Confirm who will arrange the witnesses. Do not assume a notary visit includes witness provision.
- Coordinate everyone’s availability and any facility access rules before confirming the meeting. Ask what identification witnesses should bring for the procedure involved.
If the request concerns a power of attorney, review our power of attorney service information. For a facility visit, discuss hospital and care facility arrangements in advance.
Common witness questions
Can the notary also act as my document witness?
Do not assume so. Eligibility and any conflict must be assessed for the particular document and procedure. Confirm the requirements before relying on one person for both roles.
Can a relative be a witness?
Possibly for some documents, but not universally. Document-specific restrictions and the separate rules for credible identifying witnesses matter. Ask the document recipient or an attorney about eligibility.
I do not have acceptable identification. Can I just bring two friends?
No automatic approval should be assumed. Credible-witness identification has statutory conditions. Explain the issue to Mary before scheduling so the available lawful options can be reviewed.
Can a witness replace an absent signer?
Not for an ordinary acknowledgment or jurat of that signer’s signature. Proof by a subscribing witness is a separate restricted procedure and cannot be used for powers of attorney, among other excluded documents.
Arrange the people before the appointment
Request an appointment with the document type, number of signers, meeting address, and known witness needs. Mary will review the arrangement and quote before confirming. Visit the Blog for more preparation guides.
