Notarization for Affidavits and Sworn Statements
An affidavit often requires a jurat when the signer must swear or affirm that its statements are true. For a California jurat, the signer personally appears, establishes identity, signs in the notary’s presence and takes an oath or affirmation. The notary completes the jurat certificate when the requirements are met. The notary does not verify the truth, accuracy or legal validity of the affidavit’s contents.
How a Jurat Works
- Confirm the required act
Check the document instructions or ask the receiving organization whether it requires a jurat or another notarial act. A notary cannot choose the act for you.
- Bring the complete affidavit
Have all pages and any instructions available, along with satisfactory evidence of identity permitted by California law.
- Appear and sign
For a jurat, the signer personally appears and signs the document in the notary’s presence.
- Take the oath or affirmation
The notary administers the required oath or affirmation.
- Certificate completion
If the requirements are satisfied, the notary completes the jurat certificate and journal entry. The notary does not review or validate the statements in the affidavit.

Documents Commonly Presented
Please have:
• The complete affidavit and all associated pages
• Satisfactory evidence of identity permitted by California law
• All signers who must personally appear
• Instructions from the document provider or receiving organization
If a jurat is required, do not sign the affidavit before the appointment; the signer must sign in the notary’s presence. If the document does not specify the required act, ask the provider or receiving organization before the appointment.
Acknowledgment or Jurat?
California notaries perform different types of notarial acts, including acknowledgments and jurats.
A notary cannot choose a notarial act for a customer when the document does not specify what is required.
If you are unsure which notarial act your document requires, contact the document provider, receiving agency or a qualified legal professional before the appointment.
